Foreword

The online sales website arnaudfeuga.fr is managed by the studio of the artist Arnaud Feuga, located in Baillargues, France (34670), hereinafter referred to as "the artist."

It is hereby specified that these terms and conditions govern the sales of the artist's products to any individual or legal entity making a purchase via the website arnaudfeuga.fr, hereinafter referred to as "the CUSTOMER."

These General Terms and Conditions of Sale, along with the order form and order confirmation, constitute the sales contract between the artist and the CUSTOMER relating to the sale of the products ordered.

Any order placed on the website arnaudfeuga.fr requires the CUSTOMER to first accept, without reservation, these General Terms and Conditions of Sale in their entirety.

If the CUSTOMER does not agree with the terms and conditions of these General Terms and Conditions of Sale, they must not use the website arnaudfeuga.fr.

The artist reserves the right to adapt or modify these General Terms and Conditions of Sale at any time and without prior notice. Such adaptations or modifications will then apply to all orders placed after the date of the adaptation or modification.

In the event of a modification, the General Terms and Conditions of Sale applicable to the CLIENT's order are those that were online and accepted by the CLIENT on the date the order was placed.

Article 1 – Definitions

The terms and expressions identified by an initial capital letter in these General Terms and Conditions of Sale have the meanings indicated below (whether used in the singular or plural).

General Terms and Conditions of Sale: refers to this document, namely the terms and conditions governing the relationship between the artist and the CLIENT.

Order: refers to the CLIENT's purchase order for one or more paintings or services placed through the website arnaudfeuga.fr or via Customer Service.

Website: refers to the website accessible at arnaudfeuga.fr.

Product: refers to a product or service offered for sale on the website arnaudfeuga.fr.

CLIENT: refers to a natural or legal person, a consumer, who uses the website arnaudfeuga.fr and purchases one or more paintings for their personal use, having previously agreed to the General Terms and Conditions of Sale.

Article 2. Purpose

These General Terms and Conditions of Sale aim to define the contractual relationship between the artist and the CLIENT and the conditions applicable to any purchase made through the website arnaudfeuga.fr.

By accepting these General Terms and Conditions of Sale, you declare that you have reached the age of majority in your country, state, or province of residence, and that you have given us your consent to allow any minor dependent on you to purchase from this online store.

The use of our paintings for any illegal or unauthorized purpose is prohibited.

The artist reserves the right to modify these General Terms and Conditions of Sale at any time, in order to comply with any new regulations or to improve the use of the website. Therefore, the applicable terms and conditions will be those in effect on the date the order is placed by the customer.

Article 3. Prices

The prices listed on the product pages of the online catalog are in Euros (€), inclusive of all taxes (VAT included), based on the VAT rate applicable on the date of the order, which is 5.5% in 2026. Any change in the VAT rate may be reflected in the price of the paintings.

The artist reserves the right to modify prices at any time, it being understood, however, that the price listed in the catalog on the day of the order will be the only price applicable to the CLIENT.

Paintings remain the property of arnaudfeuga.fr until full payment is received by arnaudfeuga.fr.

Paintings on sale will be indicated by a "SALE" tag or by a crossed-out price. Our sales are valid while supplies last at the time of ordering and during the advertised period.

For CLIENTS outside Metropolitan France, arnaudfeuga.fr is required, in accordance with applicable law, to charge VAT on orders shipped to most countries of the European Union.

For CLIENTS outside the European Union and French Overseas Departments and Territories (DOM-TOM), orders are not subject to VAT, but may be subject to local taxes and customs duties in the country of receipt. These fees and charges are not the responsibility of arnaudfeuga.fr and are the sole responsibility of the CLIENT.

Warning: Any inaccurate information provided by the CLIENT with the intent to evade VAT may result in civil penalties and criminal prosecution.

The prices of the Products listed on the website arnaudfeuga.fr include packaging and shipping costs. The paintings are carefully packed in wooden crates and delivered with an invoice and certificate of authenticity.

Article 4. Ordering

Contractual information is presented in French and will be confirmed in writing, reiterating this contractual information, no later than the time of delivery. The artist reserves the right to cancel or refuse any order from a customer with whom there is an existing dispute concerning payment for a previous order.

To order paintings on the website arnaudfeuga.fr, the CUSTOMER must create an account by providing the information requested on the registration form.

To this end, the CUSTOMER declares that they are providing complete and accurate personal information that will allow for their precise identification in any situation. Any fictitious or defamatory personal information may result in the closure of the CUSTOMER's account and the cancellation of their Order.

The account creation section is accessible directly from the main menu bar. Each time the CUSTOMER visits the site, if they wish to place an order or view their account (order status, personal information, etc.), they must log in using their credentials.

Article 5. Payment

The price of the paintings and the logistics and delivery fees are payable in full by the CUSTOMER at the time the Order is placed.

The website arnaudfeuga.fr offers the Customer several payment options:

By credit card:

After selecting the credit card payment method, the Customer is redirected to the secure payment system interface to safely enter their personal credit card details. If the payment is accepted, the order is registered and the contract is definitively formed. Payment by credit card is irrevocable.

By bank transfer:

After selecting bank transfer as the payment method, and upon order confirmation, the Customer receives confirmation of their order. To finalize payment and initiate order processing, the Customer must transfer the corresponding amount to the artist's bank account, the details of which are provided to the Customer at the end of the order process. Upon receipt of the transfer, the order will be processed, and the Customer will be notified by email.

By check:

After selecting check as the payment method, and upon order confirmation, the Customer receives confirmation of their order. To finalize payment and initiate order processing, the Customer must print this order confirmation and send it, along with a check made payable to the artist, to the address listed in the Contact section.

No cash payments should be sent. In the case of payment by bank check, it must be drawn on a bank located in Metropolitan France or Monaco. Upon receipt of the check, the order will be processed and the Customer will be notified by email. The artist will ship the paintings within approximately 10 days, allowing time for bank verification of funds.

Article 6. Right of Withdrawal

In accordance with Article L121-21 of the French Consumer Code, the Customer has fourteen working days from the date of receipt of their order to exercise their right of withdrawal and return the product to the seller for exchange or refund without penalty.

The paintings must be returned in their original packaging, unused, and accompanied by the original signed delivery note. Return shipping costs are the responsibility of the Customer.

Article 7. Delivery

The paintings will be delivered, after payment for the Order has been processed, to the delivery address provided by the Customer when placing the Order. An email will be sent to the CLIENT to inform them of the shipment of the paintings. The CLIENT may choose from several delivery options.

Shipping costs are calculated based on the chosen delivery method (home delivery, collection point, post office, etc.), the weight of the package, and the destination.

Delivery times are estimates only. If delivery exceeds thirty days from the date of the order, the sales contract may be canceled and the Client refunded.

Article 8. Guarantee

All paintings offered by the artist on the website arnaudfeuga.fr are covered by the legal guarantee stipulated in Articles 1641 et seq. of the French Civil Code.

In the event of a painting being defective, it may be returned to the artist, who will accept the return, exchange the painting, or issue a refund. All claims, requests for exchange, or refunds must be made by mail to the artist's address listed in the Contact section within thirty days of delivery.

Article 9. Liability

The artist is only bound by an obligation of means for all stages of access to the website, the ordering process, delivery, customer service, and after-sales services. The artist cannot be held liable for any inconvenience or damage inherent in the use of the internet, including but not limited to data loss, intrusion, viruses, service interruptions, and other unintentional problems, or for any event deemed to be force majeure, in accordance with applicable law.

The computerized records stored in the artist's information systems under reasonable security conditions will be considered proof of communications, orders, and payments made between the artist and the Client.

Article 10 - Security

The arnaudfeuga.fr website uses a security system: it employs SSL encryption and is further reinforced by scrambling and encryption processes to protect all sensitive data related to payment methods as effectively as possible.

Article 11 - Intellectual Property

All texts, comments, works, illustrations, and images reproduced on the arnaudfeuga.fr website are protected by copyright and intellectual property rights worldwide. As such, and in accordance with the provisions of the Intellectual Property Code, only use for private purposes is authorized, subject to any different or more restrictive provisions of the Intellectual Property Code. Any reproduction, in whole or in part, of the website arnaudfeuga.fr is strictly prohibited, whether in the form of photos, logos, visuals or text.

Article 12. Personal Data

All data you provide on the arnaudfeuga.fr website is used solely for processing your orders.

In accordance with French Law No. 78-17 of January 6, 1978, concerning information technology, data files, and civil liberties, you have the right to access, rectify, modify, or delete the data you have provided to the seller. This right can also be exercised online.

In accordance with Article L612-2 of the French Consumer Code, one of the prerequisites for the mediator to examine the dispute is that the consumer must demonstrate having first attempted to resolve the dispute directly with the artist, by submitting a complaint via mail or email according to the procedures defined in Article 16.

Article 14. Force Majeure

The artist's performance of all or part of their obligations, particularly delivery, will be suspended in the event of a fortuitous event or force majeure that hinders or delays such performance.

Events considered as such include, but are not limited to, war, riots, insurrection, civil unrest, and strikes of any kind.

The artist will inform the CLIENTS of the occurrence of an unforeseen event or force majeure within seven days of its occurrence. Should this suspension continue beyond fifteen days, the CLIENT may cancel the order, and a refund of the price of the ordered paintings and the delivery charges paid will be issued.

Article 15. Applicable Law and Jurisdiction

These General Terms and Conditions of Sale are governed by French law. Only the French version of these General Terms and Conditions of Sale is legally binding. In the event of any difficulty arising during the ordering process, the delivery of the paintings, or more generally, the execution of the sale, the CLIENT may, before taking any legal action, seek an amicable solution, in particular with the assistance of a consumer association or any other advisor of their choice.
